Craig Fuller Property (“we”, “us”, “our”) is a professional property buying and search agency acting on behalf of clients (“you”, “your”) who instruct us to help them find and acquire property.

These Terms & Conditions, together with our Privacy Notice, explain how we collect, use and protect your information when you submit your details, complete a property search brief, use our client portal, or otherwise instruct us to act on your behalf.

2.Personal information we collect

In order for us to provide our property buying and property search services, we need to collect and hold information supplied by you. This may include, where relevant:

  • Your full name
  • Contact details, including telephone number and email address
  • Your address and correspondence address
  • Your property search requirements and preferences
  • Your budget and financial parameters relevant to the search
  • Family or household requirements relevant to finding a property
  • Information about your current property or circumstances where relevant to the service
  • Your viewing preferences and availability
  • Any other information you voluntarily provide that is relevant to your property search

This information is collected and used only as necessary to provide and manage our property-buying and property-search services, communicate with you, understand your requirements, identify suitable properties, arrange viewings and progress your search.

3.Confidentiality and handling of your information

We treat your information as confidential and handle it carefully and securely. We do not sell your personal information, and we do not use it as a commercial mailing list for third parties.

However, so that we can properly carry out your property search or transaction, we may need to share your information with appropriate third parties where this is genuinely necessary. This may include, for example:

  • Estate agents and selling agents
  • Property professionals
  • Surveyors and valuers
  • Solicitors and conveyancers
  • Contractors or other relevant parties involved in your property purchase

Only information that is reasonably necessary for the particular purpose is shared, and we expect the parties we work with to handle your information with the same care and discretion.

We will not use your data for unrelated marketing, sell it to third parties, or use it for purposes unconnected with the property-search service unless you have separately agreed to this.

5.Legal and data protection requirements

We process your personal information in accordance with UK GDPR and applicable UK data protection law, following the principles of lawfulness, fairness, transparency, purpose limitation, data minimisation, security and appropriate retention.

We rely on the following lawful bases to process your personal information:

  • Contractual necessity - to take steps before entering into our agreement with you and to perform that agreement once you instruct us. This covers processing such as understanding your brief, searching for properties, arranging viewings and progressing your purchase.
  • Legitimate interests - to administer and improve our service, maintain records, and communicate with you about your search, where doing so is in our legitimate interests and does not override your rights.
  • Legal obligation - where we are required to process information to comply with a legal or regulatory duty (for example, anti-money laundering checks where applicable).
  • Consent - only for processing that is not necessary to provide the service, such as sending you optional marketing communications. Where we rely on consent, you can withdraw it at any time.

We do not claim that your consent is required for processing that is necessary to provide the service; that processing relies on contractual necessity or legitimate interests instead.

6.Your agreement

By submitting your details, completing the client brief, using the client portal, or otherwise instructing Craig Fuller Property, you acknowledge that:

  • You have provided your information voluntarily and understand why it is required.
  • Craig Fuller Property needs to collect and use relevant personal information in order to provide its services.
  • Your information will be handled confidentially and securely.
  • Your information may be shared with appropriate parties where reasonably necessary to provide the property-buying service.
  • Your information will not be sold to third parties.
